Terms of Service

These terms govern use of PopGenie Apps' Shopify apps, provided by PopGenie Apps ("we," "us"). This version applies to Spin Rewards Pro (the "App"). By installing or using the App, a merchant ("you") agrees to these terms. This is a draft for a small business and not a substitute for legal advice.

1. The service

The App lets you add a spin-to-win discount wheel popup to your Shopify storefront. Shoppers who interact with the widget may receive a unique, single-use discount code created in your Shopify store. The App also shows you leads and basic performance stats (impressions and spins) in its admin screens.

2. Accounts

You access the App through your Shopify account. You are responsible for maintaining the security of your Shopify account and for all activity that occurs through the App on your store.

3. Subscription and billing

The App is billed through Shopify's billing API. Subscription charges, trial periods, and billing cycles are shown to you at checkout inside Shopify and managed through your Shopify billing settings. You can cancel your subscription at any time by uninstalling the App from your store; there is no separate cancellation process outside Shopify.

4. Your responsibilities

You are responsible for:

• Ensuring you have appropriate consent and legal basis to collect marketing contact information (email/phone) from your shoppers through the widget, and for how you use those leads (e.g. complying with applicable marketing and anti-spam laws when you contact them).
• Setting discount terms (values, expiry, eligible products) that comply with applicable consumer protection and advertising laws, and honoring discount codes issued through the App.
• The content and design of your campaigns, including any claims made in your popup.

5. Acceptable use

You agree not to use the App to: violate any law; collect data from shoppers without appropriate notice or consent; misrepresent discounts or run deceptive promotions; interfere with or disrupt the App's infrastructure; or attempt to access other merchants' data.

6. Availability

PopGenie Apps apps, including the App, are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the App will be uninterrupted, error-free, or available at all times.

7. Limitation of liability

To the maximum extent permitted by law, PopGenie Apps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the three months before the claim arose.

8. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App if you violate these terms, misuse the App, or if required to do so by Shopify. Upon termination, data is handled as described in our Privacy Policy.

9. Changes to these terms

We may update these terms from time to time. We will update the effective date above when we do. Continued use of the App after changes take effect means you accept the updated terms.

10. Governing law

These terms are governed by the laws of India. Any dispute arising from these terms or from your use of the service is subject to the exclusive jurisdiction of the courts of India.
